Criminal Confiscation
Confiscation is linked directly to a criminal prosecution, is dealt with on conviction, and assesses both the benefit derived from the criminal activity and the assets available to the offender (from any source and which need not actually relate to the criminal activity in order to deprive the individual of the proceeds of their criminality and repay the benefit obtained to the government.
It is increasingly becoming an integral part of criminal investigation and under a recently announced initiative a percentage of all funds recovered can be returned to the participants involved in the prosecution in order to provide an incentive for pursuing such action.
The Agency can undertake confiscation investigations in support of any law enforcement agency in England, Wales, or Northern Ireland engaged in the prosecution of suitable offences relating to acquisitive crime.
